I. IDENTIFICATION OF THE RESPONSIBLE PARTY.
In Nu Tulum, S.A. de C.V. hereinafter LA VALISE BACALAR, located at Cancún–Chetumal Highway KM 4.5, C.P. 77963, Bacalar, Quintana Roo, Mexico; we inform you that the personal information of all our clients and potential clients is treated in a strictly confidential manner. Therefore, clients can feel fully confident that when purchasing our goods and/or services, we make a permanent effort to safeguard and protect their information.
II. MEANS OF OBTAINING AND COLLECTING PERSONAL DATA.
LA VALISE BACALAR collects the personal data necessary and applicable to comply with the purposes of this Privacy Notice, depending on the relationship that exists with the client:
a. Personal data collected in person:
Personal identification data, financial data, and third-party data (when providing personal data of third parties, it is understood that the consent of the data owner has been provided).
b. Personal data collected directly through website, email, and telephone:

c. Personal data collected indirectly through third-party transfers and publicly available sources permitted by law:

Clients are informed that images and audio captured through the video surveillance system are used solely for the safety of guests and visitors. When participating in events, captured images and audio may be distributed through internal communication channels and official social media platforms. Additionally, audio recorded through customer service media will be used to monitor and improve service quality.
III. PURPOSE
More than a policy, LA VALISE BACALAR has the philosophy of maintaining a close and active relationship with clients and potential clients. In terms of the provisions of the Federal Law for the Protection of Personal Data Held by Private Parties (the Law) and its Regulations, the personal data provided to us will be used for the following purposes:
a. Necessary for the provision of the service:
i. To perform tasks and procedures for the acquisition of goods, products, and/or services for our clients and potential clients.
ii. To provide the client with lodging services, which include restaurants (food and beverages), bars, entertainment, recreational activities, boutique, and spa services.
iii. To provide customer programs and diverse recreational, cultural, entertainment, and wellness activities.
iv. To provide Concierge services and access to medical services (external provider available 24 hours a day, independent service with charges for consultation).
v. To complete guest registration and process charges to credit and/or debit cards.
vi. To make reservations according to the specifications and needs of the guest, as well as to make changes to reservations or cancel services.
vii. To obtain credit card data, which will only be used to collect payment for services requested by the client and as a reservation guarantee, issuing a charge only in the event of non-compliance with the reservation cancellation policy.
viii. To provide event services (events and banquets), tourism, and commercial services requested by the client.
ix. To comply with contractual obligations that have been entered into pursuant to the existing commercial relationship.
x. To process requests and carry out collection, billing, and clarification activities.
xi. To keep our records updated to answer your inquiries.
xii. To comply with laws, regulations, and other applicable legal provisions.
b. Not necessary for the provision of the service:
- To carry out marketing, advertising, and commercial research activities for various goods, products, and services offered by LA VALISE BACALAR.
- To carry out internal studies on consumer habits, marketing, advertising, and commercial research related to goods, products, and services offered by LA VALISE BACALAR.
- To follow up on the commercial relationship and request evaluations to determine the level of satisfaction with our goods, products, and services.
It is important to mention that purposes (i), (ii), (iii), (iv), (v), (vi), (vii), (viii), (ix), (x), (xi), and (xii) originate and are necessary.
Purposes (1), (2), and (3) are not necessary, but are important to offer clients, through marketing, advertising, and commercial prospection campaigns, exclusive goods, products, and services, for which they have the right to object, or to revoke their consent for LA VALISE BACALAR to stop processing personal data for such purposes, in accordance with the procedure indicated in section IV or V of this Privacy Notice.
It is hereby acknowledged that the client has a period of 5 business days to express refusal regarding the processing of personal identification data in relation to the purposes of subsection (b) of this section, in accordance with the mechanism established in section IV of this Privacy Notice.
IV. OPTIONS TO LIMIT THE USE OR DISCLOSURE OF YOUR PERSONAL DATA.
LA VALISE BACALAR informs you that if you wish to stop receiving marketing, advertising, or commercial prospecting messages related to the purposes referred to in subsection (b) of section III, you may do so by sending an email to bacalar@lavalise.com. Any questions or comments regarding the processing of personal data will also be handled through this address.
V. APPLICATION FOR ACCESS, RECTIFICATION, CANCELLATION, OR OPPOSITION OF PERSONAL DATA (ARCO RIGHTS) AND REVOCATION OF CONSENT.
All personal data is processed in accordance with applicable legislation in force in the country. We inform our clients that they have the right to access, rectify, cancel, or oppose the processing of their personal data at any time, as well as to revoke the consent granted for its treatment. These rights may be asserted through the Reception Manager, designated by LA VALISE BACALAR for this purpose, or by sending an email to bacalar@lavalise.com to request the ARCO Rights Application Form. This form must be submitted to the address of the Responsible Party, accompanied by a copy of an official identification to prove identity.
The response to ARCO Rights requests will be sent to the provided email address within 20 business days from receipt of the request. Access to personal data will be deemed fulfilled upon sending the response to the specified email address.
Exercising ARCO Rights is free of charge; however, the data owner must cover shipping, reproduction, and/or document certification costs when applicable. If the owner exercises the same right within a period shorter than 12 months, the response cost will not exceed three days of the minimum wage in force in Mexico City. If clients disagree with the processing of their personal data, they may contact the INAI.
VI. TRANSFERS OF PERSONAL DATA.
Transfers without consent:
Clients are informed that to fulfill the purposes set forth in subsection (a) of section III of this Privacy Notice, personal data may be transferred and processed inside and outside Mexico by entities other than LA VALISE BACALAR. Pursuant to the Law and its Regulations, personal data may be transferred without consent to:
(i) Third-party service providers, solely for the fulfillment of the purposes established in subsection (a) of section III of this Privacy Notice;
(ii) Third-party service providers for social, tourist, and commercial events;
(iii) Authorities and emergency services; and
(iv) Third parties to carry out extrajudicial and judicial collections in case of non-compliance.
Transfers with consent:
LA VALISE BACALAR may transfer personal identification data to marketing and advertising companies for the purposes described in subsection (b) of section III of this Privacy Notice, as well as to other companies in the tourism, goods, and services sectors with which a commercial or business relationship exists to grant benefits upon purchase. If a client does not wish for personal data to be transferred to third parties, refusal may be expressed following the procedure established in section IV of this Privacy Notice.
VII. USE OF COOKIES:
LA VALISE BACALAR informs you that it uses cookies and web beacons to collect personal information automatically. The personal data collected electronically and the processing purposes are established in this Privacy Notice and consist of:
(1) Session cookies, used solely to access our website; and
(2) Preference cookies, used solely to remember preferences and browsing habits regarding our website and services.
Cookies and web beacons can be disabled by following the instructions provided through the browser settings link on our website. Cookies required for technical reasons for website operation cannot be disabled.
VIII. MODIFICATIONS TO THE PRIVACY NOTICE.
This Privacy Notice may be modified periodically by LA VALISE BACALAR. Such modifications can be consulted through the following means:

- Any other oral, printed, or electronic communication channel designated by LA VALISE BACALAR for this purpose.
